What is the Brokerage Relationship Disclosure

The Brokerage Relationship Disclosure is a document required by law in many states, including Florida, to inform clients about the nature of the relationship they will have with a real estate brokerage and its agents. This disclosure is essential for ensuring transparency and helping clients understand the duties and obligations their real estate professional owes them.

 Single Agent Notice

Single Agent: A single agent represents either the buyer or the seller, but never both in the same transaction. They have a fiduciary duty to their client, which includes loyalty, confidentiality, full disclosure, obedience, and accounting.

FLORIDA LAW REQUIRES THAT REAL ESTATE LICENSEES OPERATING AS SINGLE AGENTS DISCLOSE TO BUYERS AND SELLERS THEIR DUTIES.  

 As a single agent, _____________ and its associates owe to you the following duties:

  1. Dealing honestly and fairly;

  2. Loyalty;

  3. Confidentiality;

  4. Obedience;

  5. Full disclosure;

  6. Accounting for all funds;

  7. Skill, care, and diligence in the transaction;

  8. Presenting all offers and counteroffers in a timely manner, unless a party has previously directed the licensee otherwise in writing; and

  9. Disclosing all known facts that materially affect the value of residential real property and are not readily observable

Transaction Broker

As a “transaction broker”, ___________ and its associates, provides to you a limited form of representation that includes the following duties:

  1. Dealing honestly and fairly;

  2. Accounting for all funds;

  3. Using skill, care, and diligence in the transaction;

  4. Disclosing all known facts that materially affect the value of residential real property and are not readily observable to the buyer;

  5. Presenting all offers and counteroffers in a timely manner, unless a party has previously directed the licensee otherwise in writing;

  6. Limited confidentiality, unless waived in writing by a party. This limited confidentiality will prevent disclosure that the seller will accept a price less than the asking or listed price, that the buyer will pay a price greater than the price submitted in a written offer, of the motivation of any party for selling or buying property, that a seller or buyer will agree to financing terms other than those offered, or of any other information requested by a party to remain confidential; and

  7. Any additional duties that are entered into by this or by separate written agreement.

Limited representation: Limited representation means that a buyer or seller is not responsible for the acts of the licensee. Additionally, parties are giving up their rights to the undivided loyalty of the licensee. This aspect of limited representation allows a licensee to facilitate a real estate transaction by assisting both the buyer and the seller, but a licensee will not work to represent one party to the detriment of the other party when acting as a transaction broker to both parties.

Meet David De Simone

A Versatile Professional with a Passion for Real Estate

Background: Starting my existence on Long Island, NY, I honed a diverse skill set encompassing general construction, plumbing, electrical, all things that go into a developing or building property, under the guidance of family from a young age. These foundational skills have remained pivotal throughout my life's journey.

 

Professional Journey: Before delving into the realm of real estate, I was in the intelligent structure industry primarily in luxury residential, commercial, educational, as well. in the NY and surrounding areas collaborating with owners, top architects, designers, and executives from concept to completion.  Along with providing customer service to a Luxe Life Clientele.  

 

Embracing South Florida:  I relocate to Florida in 2004 to start my own business and twelve year later, living in Boca Raton, five office locations and over 1500 luxury properties on land and sea for a global customer base under our belt along with some sprinkles of commercial, educational, and government.  These enriching experiences shaped my expertise and insights.

 

Turning Point: Having achieved significant milestones in my journey, and from my experience in real estate, led me to embarked on a new path. To leverage my knowledge in a more impactful way.   I sold my firm and redirected my focus to the dynamic world of real estate, driven by a desire to well, Be Better.  “commission free” “a la carte” Better

 

Since 2004, I've called South Florida home. Amidst raising a family and indulging in my passion for tennis, and nature in general, the Florida weather, opportunities, and environment is a great place to live and invest in Real Estate, if done wisely.
